Acceptance of these terms

By accessing any page of this domain, the visitor accepts these terms of use in full. If the visitor does not accept these terms, the visitor is requested not to access, browse, or otherwise use this site. The firm may amend these terms from time to time; the version in force is the version published at this URL.

§ 2

Purpose & status of the material

The content of this site is supplied for orientation only. It does not constitute a contractual offer, an invitation to treat, an inducement to enter into any transaction, professional advice, investment advice, legal advice, tax advice, or medical advice. Reliance placed on the content of this site is therefore strictly at the visitor’s own risk.

Mandates for the services described are accepted exclusively under separately negotiated written agreements concluded with vetted business counterparties, following customary counterparty diligence.

§ 3

No representation of investment or financial services

Nothing on this site constitutes the offer, sale, or solicitation of any security, derivative, fund interest, payment service, or other regulated financial instrument or service in any jurisdiction. The firm is not authorised as a credit institution, a regulated financial-services firm, a payment-services provider, an insurance intermediary, or a securities dealer.

§ 4

Intellectual property

All text, graphics, layout choices, source code, trade marks, logos, and other expressive material presented on this site are the intellectual property of Three [Online] Services FZE or are used under licence. Subject to clause 5, the visitor is granted a limited, non-exclusive, non-transferable, revocable licence to access and view the content of this site for the visitor’s own internal informational purposes.

No part of this site may be reproduced, distributed, publicly performed, modified, translated, included in a derivative work, incorporated into any product or service, scraped at scale, or included in any machine-learning training corpus, without the prior written permission of the firm.

§ 5

Permitted & prohibited uses

The visitor undertakes not to:

  • use this site in any manner that is unlawful, fraudulent, or has any unlawful or fraudulent purpose or effect;
  • attempt to gain unauthorised access to, interfere with, damage, or disrupt any part of this site, the server on which this site is stored, or any server, computer, or database connected to this site;
  • transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material through any contact mechanism made available on this site;
  • extract, copy, or reuse any substantial part of the contents of this site, including by automated means, other than as expressly permitted under clause 4.
§ 6

Availability of the site

The firm makes the site available on an “as is” and “as available” basis. The firm does not warrant that the site, or any part of it, will always be available, accessible without interruption, or free from errors, viruses, or other harmful components. The firm reserves the right to suspend, withdraw, modify, or restrict access to any part of the site, temporarily or permanently, without notice.

§ 7

Disclaimers

To the maximum extent permitted by applicable law, the firm excludes all representations, warranties, conditions, and other terms which might otherwise be implied by statute, common law, or the law of equity in respect of the site and its content, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

§ 8

Limitation of liability

To the maximum extent permitted by applicable law, the firm shall not be liable to any visitor, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any loss or damage arising under or in connection with the visitor’s use of, or inability to use, this site, including (without limitation) loss of profits, loss of business, loss of goodwill, loss of anticipated savings, business interruption, or loss of, or damage to, data or information.

Nothing in these terms excludes or limits the firm’s liability for fraud, fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.

§ 9

Third-party links

This site may contain links to third-party websites or resources. Such links are provided for convenience only and do not signify endorsement. The firm has no control over the contents of those sites and accepts no responsibility for them or for any loss or damage that may arise from the visitor’s use of them.

§ 10

Privacy

The processing of personal information in connection with this site is described in the firm’s privacy notice, which forms an integral part of these terms.

§ 11

Sanctions & export controls

The firm complies with applicable economic-sanctions and export-control regimes. The site and the firm’s services are not directed at, and are not to be used by, persons or entities ordinarily resident in, established in, or owned or controlled by persons in, jurisdictions that are subject to comprehensive sanctions imposed by the United Nations, the United States, the European Union, the United Kingdom, or the United Arab Emirates.

§ 12

Force majeure

The firm shall not be liable for any failure to perform, or delay in the performance of, any of its obligations in connection with this site that is caused by events outside its reasonable control, including (without limitation) acts of God, war, terrorism, civil unrest, government action, epidemic, network outage, or failure of public or private telecommunications infrastructure.

§ 13

Severability & waiver

If any provision of these terms is held to be invalid or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect. A failure or delay by the firm to exercise any right or remedy provided under these terms or by law shall not constitute a waiver of that or any other right or remedy.

§ 14

Governing law & jurisdiction

These terms, their subject matter and their formation (and any non-contractual disputes or claims arising out of or in connection with them) are governed by the laws in force in the Emirate of Umm Al Quwain and the federal laws of the United Arab Emirates. The competent courts of the Emirate of Umm Al Quwain have exclusive jurisdiction, without prejudice to mandatory consumer protection rules of the visitor’s place of habitual residence where those would otherwise apply.
